1. Agreement

These Terms of Use (“Terms”) govern your access to and use of Windrose Atlas (the “Site”), including all content, tools, and services made available through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

2. Description of the service

The Site provides fan-created reference materials related to the video game Windrose, including but not limited to wiki-style data tables, articles, guides, and an interactive map. The Site is offered for informational and entertainment purposes. We may modify, suspend, or discontinue any part of the Site at any time without prior notice, except where prohibited by law.

3. Eligibility and acceptable use

You represent that you have the legal capacity to agree to these Terms in your jurisdiction. You agree to use the Site only in compliance with applicable laws and regulations. Without limitation, you must not:

  • Attempt to gain unauthorized access to the Site, its systems, or related infrastructure;
  • Use automated means (including scraping or bots) in a manner that overloads or disrupts the Site;
  • Introduce malware, exploit vulnerabilities, or interfere with other users’ access;
  • Use the Site to harass, defame, or harm others, or to distribute unlawful content;
  • Misrepresent your affiliation with any person or entity, including the game’s rights holders.

4. Intellectual property and trademarks

Windrose, related titles, logos, artwork, and other materials are the property of their respective owners. The Site is an independent fan project and is not sponsored, endorsed, or affiliated with the game’s developers or publishers unless expressly stated in writing by those parties.

Original text, layout, and compilations on the Site are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site’s proprietary materials except as permitted by law or with our prior written consent.

5. User content

If the Site allows you to submit or transmit content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely for the purpose of operating the Site. You represent that you have all rights necessary to grant such a license and that your content does not infringe third-party rights. We may remove content that violates these Terms or applicable law.

6. Third-party links and services

The Site may link to third-party websites, stores, or tools (for example, official game pages or community resources). Those services are governed by their own terms and policies. We are not responsible for the availability, accuracy, or practices of third-party sites.

7. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Game data, statistics, and map coordinates may be incomplete, approximate, or outdated following patches. You are solely responsible for decisions you make in-game or elsewhere based on information obtained from the Site.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SITE OPERATOR, CONTRIBUTORS, OR THEIR RESPECTIVE AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, TO USE THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), UNLESS A DIFFERENT MINIMUM APPLIES UNDER MANDATORY LOCAL LAW.

9. Indemnity

To the extent permitted by law, you agree to indemnify, defend, and hold harmless the Site operator and its contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Site at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. General

These Terms constitute the entire agreement between you and us regarding the Site and supersede any prior understandings on the same subject. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision.

We may revise these Terms from time to time. The “Last updated” date above reflects the latest revision. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms, except where your explicit consent is required by law.
